1. Acceptance

By accessing or using Viralvext (the "Service") you agree to these Terms & Conditions. If you do not agree, do not use the Service.

2. The Service

Viralvext lets you generate thumbnails using AI. We may add, change, or remove features at any time to improve the product.

3. Accounts

You are responsible for keeping your account credentials secure and for all activity that happens under your account. You must provide accurate information and be at least 13 years old to use the Service.

By uploading images to ViralVext, you confirm that you own the rights to all uploaded content. ViralVext is not responsible for copyright violations caused by user uploads.

4. Credits, plans, and payments

• The Service uses a credit system. Each generation deducts credits from your balance.
• Paid credits never expire. The Free plan grants 50 credits every 2 months, resetting automatically every 60 days.
• Payments are processed by Stripe. By purchasing credits you agree to Stripe's terms in addition to ours.
• All purchases are final and non-refundable except where required by law or at our sole discretion.
• We may change pricing at any time; changes will not affect credits you have already purchased.

5. Acceptable use

You agree not to use the Service to:

• Generate content that is illegal, hateful, harassing, sexually explicit involving minors, or that violates anyone's rights.
• Upload photos of other people without their permission, or impersonate someone in a misleading way.
• Attempt to reverse engineer, abuse, or overload the Service.
• Resell access to the Service without our written permission.

We may suspend or terminate accounts that violate these rules.

6. Prohibited activities

You agree not to:

• Collect or scrape data from ViralVext automatically or using bots.
• Attempt to copy, reverse engineer or resell the ViralVext software.
• Use the service to impersonate other people or spread false information.
• Upload viruses or malicious code.
• Use automated scripts to abuse the credit system.

7. Your content

You keep ownership of the photos, titles, and descriptions you upload. You grant us a limited license to process that content (including sending it to OpenAI) for the sole purpose of generating thumbnails for you.

Users are solely responsible for ensuring they have appropriate rights and permissions for all images uploaded. VIRALvext does not verify image ownership and accepts no liability for copyright infringement caused by user uploads.

VIRALvext operates solely as a creative tool. We do not publish, distribute or control how generated thumbnails are used. All responsibility for publishing and copyright compliance rests entirely with the user.

8. Indemnification

You agree to hold ViralVext harmless from any claims, damages or costs arising from your use of the service, your uploaded content, or your violation of these Terms.

9. AI-generated thumbnails

Thumbnails are generated by AI based on your inputs. Subject to these Terms and applicable law, you may use thumbnails generated on your account for personal channel use. Commercial use is permitted on the Pro plan.

AI output may sometimes be inaccurate, unexpected, or similar to other outputs. You are responsible for reviewing a thumbnail before publishing it and for making sure it complies with the rules of the platform you post it on.

10. Intellectual property

The Viralvext name, logo, software, and design are our property. These Terms do not transfer any of our intellectual property to you.

11. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that any specific thumbnail will perform well.

12. Limitation of liability

To the maximum extent permitted by law, Viralvext and its operators will not be liable for any indirect, incidental, or consequential damages. Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months before the claim.

13. Corrections

We reserve the right to correct any errors or inaccuracies on the website at any time without prior notice.

14. Termination

You can stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service.

15. Changes

We may update these Terms from time to time. If the changes are material, we will notify you through the Service or by email. Continued use after the changes take effect means you accept the new Terms.

17. Governing Law

These Terms are governed by the laws of Sweden. Any disputes will be resolved in the courts of Sweden. If you are a consumer in the EU, you may also benefit from mandatory provisions of the law of your country of residence.
